Moving to New York State - What You Should Know

Whether you're moving to the bucolic mountainside in upstate New York or the bustling metropolis that is New York City, moving to New York State from another state is unlike any experience you'll ever have. To help ease your move to New York State, I've compiled a list of useful information that will guide your first days in your new home. With the proper planning, there's no reason why your move to New York State should be anything but exciting.

Driving Regulations and Licensing

  • If you plan to file for residency when you move to New York State, you must also request a NYS driver's license within 30 days of confirming your residency. In most cases you will be required to surrender your out-of-state driver's license.
  • New York State does not grant driving privileges to people under age 16, even if you they have a valid learner's permit or driver's license from another state.
  • New York State does not grant driving privileges to people under age 18 if they do not possess a valid NYS driver's permit or license.

Marriage Rules and Regulations

  • If you are moving to New York State in order to get married, it is most important to know that there is a required 24 hour waiting period between receiving your marriage license and performing the marriage ceremony. In some cases, this waiting period can be waived with a judicial waiver.
  • You need not be an official resident of New York State in order to get married within its borders.
  • The bride and groom must both be present in order to apply for (and receive) a marriage license.
  • New York State does not demand blood tests as a prerequisite for granting a marriage license.
  • Siblings (full or half-blood) and other close relatives such as uncles and nieces or aunts and nephews may not be married in the State of New York.

New York State Tax Regulations

  • After moving to New York, you will be required to pay New York State income tax on all earnings. New York State tax rates (as of May 2009) are structured as follows:

  • New York State property tax is determined based upon the value of your property as determined by a qualified assessor. After moving to New York State you can request tax reduction assistance or abatements as part of the following programs (among others):
    1. Disability Homeowner Exemption (DHE) - available to homeowners with qualified disabilities
    2. Clergy Exemption - available for 1 property owned by ministers, priests, rabbis and imams
    3. STAR Exemption (NYS School Tax Relief)- available for owners of 1, 2 and 3 family homes (primarily), this exemption can save you about $200/year on your property taxes
  • New York State sales tax is 4%, though each city also adds its own local tax, which can range from 3-4.75%.

Finally, when moving to New York (whether you're moving from California or New Jersey), it is important to remember that if you want to make a claim or complaint against your New York mover, you must contact the USDOT Federal Motor Carrier Safety Administration and your mover as soon as possible. Your New York mover will be required to respond to your complaint within 30 days and resolve the dispute within 120 days. Of course, I hope that your move is entirely smooth and that this warning will be entirely unnecessary!
